    ARTICLE 1 : INTRODUCTION – Maintaining control over your personal data

    On May 25, 2018, the General Data Protection Regulation (GDPR) took effect. The GDPR aims to provide you with greater transparency and control over your data.

    In the promotion of our solution and in order to assist our customers with the implementation of their DAM projects, our sales department is required to collect a minimum amount of personal data via the various forms on the website.

    This Privacy Policy supplements the Legal Notices and General Terms and Conditions of Usage.

    ARTICLE 2 : General principles regarding data collection and processing

    In accordance with the provisions of Article 5 of European Regulation 2016/679, the collection and processing of data from website users complies with the following principles:

    • Legitimacy, honesty, and transparency: data can only be collected and processed with the consent of the user who owns said data. Whenever personal data are to be collected, the user will be notified that their data will be collected, along with the reasons for collection of their data;

    • Minimization of data collection and processing: only data necessary for attaining the objectives pursued by the website are collected;
    • Time-limited storage of data: the data are stored for a limited duration, of which the user is informed;
    • Integrity and privacy of the data collected and processed: the data controller undertakes to guarantee the integrity and privacy of the collected data.

    To be licit, according to the requirements of Article 6 of European Regulation 2016/679, the collection and processing of personal data can only happen if they meet at least one of the following conditions:

    • The processing if for compliance with a legal obligation;
    • The processing can be explained by a need to protect the vital interests of the person concerned or of another physical person;
    • The processing can be explained by a need related to carrying out a mission in the public interest or related to the exercise of government authority;
    • The processing and collection of the personal data are necessary for the purposes of legitimate private interests pursued by the data controller or by a third party.

    ARTICLE 3 : Personal data collected and processed as part of navigation on the website

    The collection and processing of data are for the following purposes: data collected when a contact form is completed are used to respond quickly and effectively to the needs and requests expressed. The data are stored in our customer relationship management (CRM) system so that contact may be made.

    Our company, Einden, the exclusive publisher of the Ephoto Dam solution, is the controller of all of the data collected via telephone calls, emails, professional trade fairs, and forms on the Ephoto Dam website.

    B. Obligations of the data controller

    • f. The right to refer a matter to the regulatory authority of jurisdiction

    In the event that the data controller decides to not comply with the request from the user, and if the user wishes to contest that decision, or if the user thinks that one of their rights listed above has been violated, they have the right to refer the matter to the French National Commission on Information Technology and Liberties (“CNIL,” https://www.cnil.fr) or to any judge with jurisdiction.

    B. Personal data of underage persons
    In accordance with the provisions of Article 8 of European Regulation 2016/679 and with the French Information Technology and Freedoms Law, only minors aged 15 years or older may consent to the processing of their personal data.

    SIf the user is a minor under 15 years old, the agreement of a legal representative shall be required for the personal data to be collected and processed.

    The website publisher reserves the right to verify by any means that the user is aged 15 years or older, or that they have obtained agreement from a legal representative before visiting the website.

    ARTICLE 6 : Usage of “cookie” files

    The website uses “cookies.” A “cookie” is a small file (less than 4 KB) stored by the website on the hard drive of the user, containing information about the navigation habits of the user.
